By accessing this website or placing an order, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use this website or place an order.

2. Definitions

In these Terms:

Customer, you or your means any individual or organisation purchasing products or services from us.

Products means all furniture, home accessories, cushions, fabrics and any other goods offered for sale through our website.

Commissioned Furniture means furniture designed, manufactured or adapted specifically to a customer's individual requirements.

Ready-Made Products means products available for immediate purchase without customisation.

Third-Party Fabrics means fabrics supplied by specialist manufacturers or distributors and ordered on your behalf.

Contract means the legally binding agreement between you and Swaethe Furniture once your order has been accepted by us.

3. About Our Products

Swaethe Furniture offers a carefully curated collection of furniture, home accessories and furnishing fabrics, together with commissioned furniture designed to meet individual customer requirements.

Many of our products are handmade or produced in small batches. As a result:

  • dimensions may vary slightly from those stated;

  • natural materials such as timber, leather, linen, wool and stone will display unique variations in colour, grain, texture and character;

  • handcrafted finishes may differ subtly from product photographs;

  • computer and mobile device screens may display colours differently.

These natural characteristics are not defects but are part of the individuality of each product.

Where dimensions are provided, they should be regarded as approximate unless expressly stated otherwise.

4. Website Information

We make every reasonable effort to ensure that information published on this website is accurate and up to date.

However, we cannot guarantee that:

  • all descriptions are free from error;

  • all images perfectly represent colour or finish;

  • products will always remain available;

  • prices will remain unchanged.

Where this occurs after an order has been placed we will contact you as soon as reasonably possible to discuss:

  • an estimated delivery date;

  • a suitable alternative product;

  • or a full refund where appropriate.

7. Pricing

All prices displayed on our website are shown in Pounds Sterling (£) unless otherwise stated.

Unless specifically indicated, prices include UK VAT where applicable.

International customers may be responsible for local taxes, customs duties, import charges or clearance fees imposed by their own country. These charges are not included within our prices and remain the responsibility of the customer.

We reserve the right to amend prices at any time before an order has been accepted.

Where a genuine pricing error occurs, we reserve the right to cancel the order and refund any payment received before the Contract is formed.

8. Placing an Order

When you place an order through our website you are making an offer to purchase products from Swaethe Furniture.

After placing your order you will receive an automated email acknowledging receipt of your order. This acknowledgement confirms only that we have received your order and does not constitute acceptance of your offer.

A legally binding Contract is formed only when we confirm acceptance of your order by email.

We reserve the right not to accept an order where:

  • payment cannot be authorised;

  • pricing errors have occurred;

  • products are unavailable;

  • we reasonably suspect fraudulent activity;

  • delivery cannot reasonably be fulfilled;

  • we believe acceptance would breach applicable laws or regulations.

If we are unable to accept your order after payment has been received, we will refund any sums paid as soon as reasonably practicable.

9. Commissioned Furniture

Commissioned furniture is manufactured specifically to a customer's agreed design, dimensions, materials and finish.

Before production begins we will normally provide written confirmation of the agreed specification.

It is the customer's responsibility to ensure that all dimensions, specifications, finishes and delivery access requirements have been checked and approved before manufacture begins.

Once manufacture has commenced, changes may not be possible or may incur additional charges.

Because commissioned furniture is made to your individual specification, your statutory cancellation rights under the Consumer Contracts Regulations 2013 may not apply once production has started. This does not affect your legal rights if the product is faulty or not as described.

10. Payment

Payment must be made using the payment methods available on our website unless otherwise agreed in writing.

Orders will not normally be processed until payment has been authorised.

For commissioned furniture, we may require staged payments, including:

  • a non-refundable deposit before work begins;

  • interim payments where agreed;

  • payment of the remaining balance before dispatch or installation.

The payment schedule for commissioned projects will be confirmed in writing before work commences.

Failure to make payments when due may result in delays to manufacture or delivery.

11. Deposits for Commissioned Furniture

A deposit secures production time, materials and supplier commitments.

Unless otherwise agreed in writing, deposits paid for commissioned furniture are non-refundable once materials have been ordered or manufacture has begun.

If a customer requests changes after production has commenced, we will advise whether the changes are possible and whether additional costs or revised lead times will apply.

Should a customer cancel a commissioned order after production has begun, we reserve the right to retain the deposit and recover any additional costs already incurred.

Nothing in this clause affects your statutory rights where goods are faulty or not supplied in accordance with the agreed specification.

12. Third-Party Fabrics

We supply fabrics manufactured by carefully selected third-party suppliers.

Fabric colours, textures and finishes may vary slightly between production batches.

Where fabric is ordered specifically at a customer's request, including fabric supplied for a commissioned project, cancellations or returns may not be possible once the order has been placed with our supplier.

Customers are encouraged to request fabric samples before placing an order where colour or texture is important.

Whilst we take reasonable care to describe fabrics accurately, slight colour variation between samples, photography and finished products is unavoidable.

13. Delivery

We deliver throughout the United Kingdom and to selected international destinations.

Delivery times shown on our website are estimates only and are not guaranteed.

Estimated delivery periods may be affected by:

  • supplier lead times;

  • bespoke manufacture;

  • weather conditions;

  • customs procedures;

  • courier delays;

  • circumstances beyond our reasonable control.

We will always endeavour to keep customers informed of significant delays.

International customers are responsible for any import duties, customs charges, local taxes or clearance fees payable in their country unless expressly stated otherwise.

14. Delivery of Furniture

Some furniture items require specialist delivery because of their size, weight or value.

Where applicable, we will contact you to arrange a mutually convenient delivery date.

It is your responsibility to ensure:

  • adequate access to the delivery location;

  • sufficient doorways, staircases and corridors;

  • suitable parking where necessary;

  • that someone authorised is available to receive the delivery.

If delivery cannot be completed because access has not been adequately assessed, additional delivery or storage charges may apply.

15. Inspection Upon Delivery

We recommend inspecting all goods as soon as reasonably possible after delivery.

If any item appears damaged during transit, please:

  • note the damage with the delivery company where possible;

  • photograph both the packaging and the product;

  • notify us promptly by email.

This allows us to investigate with our delivery partners and resolve any issues as quickly as possible.

16. Risk and Ownership

Risk in the goods passes to you once they have been delivered to the agreed delivery address.

Ownership of the goods remains with Swaethe Furniture until payment has been received in full, including any delivery charges or additional agreed costs.

Until ownership transfers, you must not sell, transfer or otherwise dispose of the goods.

17. Storage Charges

If delivery is delayed at your request after your order is ready for dispatch, we may agree to store the goods for a reasonable period.

Where extended storage is required, we reserve the right to charge reasonable storage costs, which will be agreed with you in advance wherever practicable.

18. International Orders

Customers ordering from outside the United Kingdom are responsible for ensuring that products comply with local laws and import requirements.

We cannot accept responsibility for delays caused by customs authorities or import procedures.

Any customs duties, import taxes, brokerage fees or similar charges are the responsibility of the customer unless expressly stated otherwise.

19. Product Care

Many of our products are manufactured using natural materials and traditional craftsmanship.

To help ensure the longevity of your purchase, customers should follow any care instructions supplied with the product.

Natural movement, ageing and patination of materials including timber, leather, brass, linen and stone are normal characteristics and should not be regarded as manufacturing defects.

Products should be used only for their intended purpose and maintained appropriately.

Damage resulting from misuse, neglect, improper care, exposure to excessive moisture, direct heat or unsuitable environmental conditions is not covered by these Terms.

20. Returns and Cancellations

Ready-Made Products

If you are purchasing as a consumer within the United Kingdom, you may have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Unless an exception applies, you may cancel your order within 14 days of receiving your goods. You must notify us in writing before returning any item.

Returned products must:

  • be unused and in their original condition;

  • include all original packaging where reasonably possible;

  • be returned within 14 days of notifying us of your cancellation.

Unless the goods are faulty or incorrectly supplied, the cost of returning items is your responsibility.

Refunds will be processed within 14 days of receiving the returned goods or satisfactory evidence that they have been returned.

Commissioned and Bespoke Furniture

Furniture made to your individual specification, dimensions, materials or finish is exempt from the standard cancellation rights provided under the Consumer Contracts Regulations once production has commenced.

This includes furniture manufactured specifically for you or substantially customised to your requirements.

Nothing in these Terms limits your legal rights where commissioned goods are faulty, damaged or not supplied as agreed.

Fabrics

Fabric that has been cut to length or specially ordered from a supplier specifically for your order cannot normally be cancelled or returned unless faulty or supplied incorrectly.

We recommend requesting samples before placing an order where colour, texture or finish is important.

21. Faulty or Damaged Goods

We take great care to ensure every product meets our quality standards.

If your order arrives damaged, faulty or not as described, please notify us as soon as reasonably possible and provide photographs where appropriate.

Where a product is confirmed to be faulty, we will, in accordance with your statutory rights, arrange an appropriate remedy, which may include:

  • repair;

  • replacement;

  • refund; or

  • another suitable resolution agreed between us.

Nothing in these Terms limits or excludes your statutory rights under the Consumer Rights Act 2015.

22. Product Warranties

Where a manufacturer's warranty applies to a product supplied by us, details will be provided where available.

Natural characteristics of timber, stone, leather, fabric and other natural materials—including grain variation, knots, colour changes, patination and movement—are not manufacturing defects and are therefore not covered as faults.

Reasonable wear and tear, accidental damage, misuse, improper maintenance or commercial use are not covered unless expressly stated otherwise.

23. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of your statutory consumer rights.

Subject to the above, Swaethe Furniture shall not be liable for any indirect or consequential losses, including:

  • loss of profit;

  • loss of business;

  • loss of opportunity;

  • loss of anticipated savings;

  • loss of goodwill.

Our total liability relating to any order shall not exceed the purchase price paid for the relevant products.

24. Intellectual Property

All content published on this website, including but not limited to:

  • photographs;

  • product descriptions;

  • drawings;

  • designs;

  • graphics;

  • logos;

  • branding;

  • text; and

  • website design,

is the property of Swaethe Furniture or its licensors and is protected by copyright, trade mark and other intellectual property laws.

No material may be copied, reproduced, distributed or used without our prior written permission.

We are not responsible for the content, availability or privacy practices of those websites and accept no liability arising from their use.

27. Events Beyond Our Control

  • transport disruption;

  • pandemics;

  • government restrictions;

  • other unforeseen events.

Where such circumstances continue for an extended period, we will work with you to agree an appropriate solution.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions shall continue in full force and effect.

29. Waiver

Failure by Swaethe Furniture to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.

30. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Delivery Policy and Returns Policy, constitute the entire agreement between you and Swaethe Furniture relating to your use of the website and the purchase of our products.

31. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws provide otherwise.
